you have to be 18 for a pipe, although I've seen shops sell them as 'incense burners'. I'm not sure about grinders, but considering you have to be 18 to be in the tobacco shop, I'd guess it's the same situation.

I've the 3 or 4 dozen headshops I've been to and the dozen or so purchases I have made within, none have ever asked for my ID. Considering I'm only 19 now, I should have been carded every time. I'm sure that it varies wildly by area and shop.
I've only been carded once at a headshop and I look like I'm 13. But yes by law you have to be 18, 19 in some states.
